A federal judge approved a class action settlement between Aetna and same-sex couples in New York who alleged discrimination in fertility treatment coverage. Aetna, a subsidiary of CVS Health Corp., agreed to cover artificial insemination and work towards equal access for in-vitro fertilization procedures nationally. This settlement allows LGBTQ couples previously denied fertility coverage to be reimbursed. Emma Goidel and Ilana Caplan filed the lawsuit after Aetna denied covering their fertility treatments, costing them over $50,000 out of pocket. Aetna declined to comment but CVS Health Corp. stated they are committed to providing quality care regardless of sexual orientation or gender identity. Thirteen states mandate fertility treatment coverage for same-sex couples, but self-funded insurance policies are exempt. Similar cases have been filed against UnitedHealthcare and Blue Cross Blue Shield. This landmark settlement brings hope for LGBTQ individuals facing barriers to starting a family. Allison Tanner from the National Women’s Law Center highlights the discomfort of discussing benefits with employers related to family planning. This case sets a precedent for addressing discrimination in fertility treatment coverage and promoting inclusivity in healthcare.
