Lackluster Legislative Session in South Carolina: Calls for Judicial Reform Intensify

As the 2025 session of the South Carolina General Assembly approaches its conclusion this Thursday, it has been marked by a noticeable absence of cooperation and significant legislative progress. While tempers have flared beneath the State House dome, little of substance has advanced for Palmetto State residents.

A glaring omission from the current session’s agenda has been judicial selection reform. Despite promises made in 2024 to overhaul the flawed system for selecting judges, legislators have largely failed to take action. This inaction has had dire consequences, evidenced by a judiciary that many believe has devolved into an extension of the legislature, with a troubling lack of accountability.

This week, however, Senator Wes Climer re-entered the conversation by filing a bill aimed at reforming the status of retired judges. Under Climer’s proposal, retired judges seeking to serve again would need to undergo performance reviews and require the approval of a majority of the General Assembly. Advocates, including Attorney General Alan Wilson, argue that it is crucial to hold judges accountable to the public, especially as some, like former Chief Justice Jean Toal, have been criticized for their controversial conduct.

Although the bill may not pass before the session ends, its introduction highlights a growing urgency for change. With impending primary elections on the horizon, legislators will face pressure to confront the pressing issue of judicial accountability. The question remains: will they act, or will the status quo persist?

The spotlight is now on lawmakers as they navigate the challenges ahead, not just for the judiciary, but for restoring public trust in a system that appears to be faltering.
