Trump Administration Requests Supreme Court to Remove Restrictions on Deportations to ‘Third Countries’


The Trump administration has asked the Supreme Court to facilitate the deportation of convicted criminals to third countries that are not their countries of origin. This appeal aims to overturn an injunction issued by U.S. District Judge Brian Murphy in Massachusetts, which mandates that immigrants facing deportation be given at least ten days to raise concerns about potential risks of torture, persecution, or death in these countries. Recently, the administration faced backlash for violating this order by deporting eight migrants to South Sudan, who are now held in a facility in Djibouti.

The main issue of the case revolves around the legal process that these deportees should follow prior to their removal, given that they are already subject to deportation. Solicitor General D. John Sauer argues that Judge Murphy’s ruling imposes unnecessary procedures that exceed his authority and disrupt vital diplomatic and national security efforts. He contends that these judicially mandated steps are complicating the third-country removal process significantly.

Judge Murphy, however, maintains that his order merely ensures basic due process for the plaintiffs. He emphasizes that they are simply requesting notification of their deportation destination and the chance to present their cases about potential dangers they face in those countries. On the night before his rejection of the government’s attempt to alter his requirements for the detainees in South Sudan, Murphy acknowledged the complications of handling immigration cases abroad. He expressed his hope that reason could prevail over rhetoric in this ongoing legal dispute.
