Judge Holds Florida Attorney General in Contempt for Disregarding Court Order in Significant Immigration Case


A federal judge found Florida Attorney General James Uthmeier in civil contempt for disregarding a court order concerning controversial immigration laws. U.S. District Judge Kathleen Williams emphasized that Uthmeier provided “implausible interpretations” of her order, which she deemed unconvincing. The judge stated, “Litigants cannot change the plain meaning of words,” and mandated Uthmeier to submit biweekly reports detailing his compliance or face potential further court action.

Williams has been overseeing a case against immigration legislation enacted by Governor Ron DeSantis, which criminalizes the entry or re-entry of individuals in the U.S. illegally. A restraining order was issued in April to prevent the enforcement of these laws, which Uthmeier acknowledged but publicly disagreed with while indicating his intention to appeal.

Just five days after the restraining order, Uthmeier sent a second notice to law enforcement, claiming that his office notified them about the order but could not prevent them from enforcing the laws due to a lack of proper judicial restraints. When questioned about his compliance, Uthmeier contended that he had neither enforced the laws nor instructed law enforcement to do so, while also admitting he would not direct agencies to stand down.

Williams highlighted Uthmeier’s defiance in interviews, where he expressed his refusal to comply, suggesting that his statements could lead to potential harm due to his noncompliance. The judge underscored the importance of respecting court orders, allowing Uthmeier to express his appeals but requiring clear communication to law enforcement about the enjoined laws. Failure to adhere to her directives could result in additional sanctions, including fines.
