Lawyer Claims Finding an Impartial Jury for Man Charged with 18 Murders May Be “Very Difficult”

In Birmingham, Alabama, Damien McDaniel, 22, awaits trial in April 2024 for his alleged role in the murders of 18 people, including during two mass shootings in July and September of 2023. With Birmingham experiencing a record 151 homicides in 2024, concerns have been raised about finding impartial jurors, as many residents are still affected by the violence. McDaniel’s lawyers worry that potential jurors may have prior knowledge or connections to the case, complicating the selection process.

District Judge Shanta Owens, who ruled that prosecutors can seek the death penalty, acknowledged the challenges of selecting jurors without significant ties to the victims. Despite public outcry and emotional scenes in the courtroom, where victims’ families were present, Owens noted the difficulty in avoiding jurors who might have some familiarity with the case. Jurors may be accepted even if they know victims tangentially, as long as they can remain impartial.

McDaniel’s legal team, emphasizing his innocence, stated that they have yet to see substantial evidence against him. John Robbins, one of McDaniel’s attorneys, articulated concerns about the feasibility of a fair trial amidst community connections to the case. Tensions were evident in the courtroom, as McDaniel’s mother clashed with a victim’s family member, necessitating intervention from court deputies.

Following the hearing, Robbins expressed concern for the safety of McDaniel’s mother, mentioning she had received death threats. The upcoming trial is set to focus first on the mass shooting outside a nightclub that claimed four lives. The courtroom’s atmosphere reflected the deep emotional impact of the violence on the Birmingham community.
